Legal advice on the EHDS and your organization

Legislation is currently being drafted in Member States to incorporate the EHDS Regulation into the national legal system. Your organization may have an interest in this being done in a particular way, for example, because you use health data for research or product development, or because you are the holder of EHDS data. Perhaps you therefore think it would be beneficial for your organization to inform the government about what constitutes good legislation. For example, EHDS data can only be made available for beneficial reuse as long as it exists. However, some of this data must be retained for only two years in the Netherlands, and other data for at least 20 years. Would you like to see a change in the legislation in this regard? The government can only consider interests that are explained to it. Another example: certain data holders can be designated as trusted holders. What does this entail? Is it beneficial for your organization to be such a trusted holder, or not? Or would you prefer to become a data broker; you can’t do both at the same time. What would be more appropriate?
